Terms of Service

Parties to agreement

The parties to this agreement are Webfootprint referred to as 'us' or 'we' and the client otherwise referred to as 'you' or 'your'.

Law of Contract.

This contract of service is governed by the law of the country where the contract is being performed. For the purposes of this agreement, this contract is being performed in New Zealand therefore this contract is governed by New Zealand Law.

Quotes and estimates

The quote provided is an estimate based on standard website (template and basic web programming), hosted on a compatible server (we recommend webbase), with all content provided.
Quotes and Estimates are valid for 7 days from the date of issue.

Website Testing

when the website has been completed, the website will be uploaded onto a test server for you to test and confirm completion.
Testing must be undertaken within 14 days of advice, or a charge may be incurred by you

Once completed, your website will be uploaded to your web hosting provider to a Live Environment.

Contract completion

The contract is considered complete 7 days after testing and implementation, or uploading to the Live Environment, unless otherwise agreed.

E-mail

We do not provide e-mail services

Hosting

We resell hosting services on either an annual or bi-annual contract, it is your responsibility to ensure your hosting is up to date. Failure to ensure payment is made may result in your website being unavailable.

Domain Names

We do not currently sell or maintain domain names for any person or company.
If you require a domain name, we recommend freeparking for this service.

Payment Terms

A deposit of (of 50% of the Quote or Estimate) Payment for work must be paid prior to the commencement of work, and the balance must be paid within 7 days from the Contract Completion by you.
Failure to make the payment within the specified period may result in the removal of any discount provided.
Further delays in payment may result in your account being assigned to a collection agent, any additional costs such as collection agency charges and legal costs are your costs, you will be liable for such.

Assignment and Subcontracting.

We may from time to time engage subcontractors to assist with various functionality of your website, you authorise us to do so and acknowledge this as part of the costs of your website.
We may assign your debt to any other creditor, collector or other party.

Where your company is sold as a going concern, you may assign your contract to the new company.

Guarantee.

By engaging Us to create or maintain your website you agree that you will ensure the account (debt) is able to be repaid. You personally guarantee the account and any outstanding balance may be recovered from you, the person engaging the service
